The article discusses the judge's opinion in the William A. Gross case in which she stressed the importance of properly crafted electronic searches. The four requirements for the production of electronically stored information (ESI) include the cooperation between opposing counsel, a careful design of appropriate keywords, selecting these keywords with input from the ESI custodians and a validation of the proposed technique to ensure it is not substantially over- or under-inclusive.
